About Kimberly
Kimberly began practicing bankruptcy in 2009 with veteran bankruptcy attorney, Fred E. Walker. She worked with Fred Walker for twelve years filing bankruptcies, suing mortgage companies, defending lawsuits, and settling debts. In 2021, Kimberly opened her own practice.
She received her J.D. from St. Mary’s Law School in 2004 and her undergraduate degree from the University of Texas at Austin. Kimberly practiced criminal defense, estate planning, and real estate law before concentrating in bankruptcy.
The Benefits of Filing Bankruptcy
Every case is different and these are the ordinary effects of a filing rather than a promise about yours. We’ll explain which of them apply to your situation before you decide anything.
How Chapter 7 worksWhat to expect
No two cases are identical, and these are the ordinary timelines rather than a guarantee. Most people are surprised how short the road is.
Day 0
Once a case is filed, an injunction or “automatic stay” goes into effect prohibiting creditors, landlords, spouses, and government entities from taking any further collection action. A foreclosure or a paycheck garnishment is halted.
Within 45 days
A trustee goes over the information I prepare on your behalf to confirm compliance with the bankruptcy code. Attendance of creditors at this meeting is uncommon and the meeting generally goes by quickly with documents in good and proper order.
About 60 days later
When no one objects, people commonly receive a Notice of Discharge by U.S. Mail about two months after the 341 meeting. Certain debts cannot be discharged, such as alimony, child support, student loans and certain taxes.
3 to 5 years
You pay your disposable monthly income into the plan for 36 to 60 months while catching up mortgage and vehicle arrears. At the end, the remainder of non-priority, unsecured debt is discharged.
